1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of services provided by Edinger Propane Gas Incorporated ("Company," "we," "us," or "our"), including but not limited to propane gas delivery, hardware sales, and online services. By engaging our services, placing orders, or using our website, you ("Customer," "you," or "your") agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, you must discontinue use of our services immediately. These Terms constitute a legally binding agreement between you and Edinger Propane Gas Incorporated.
2. Propane Delivery Services
2.1 Delivery Terms
Propane delivery services are subject to availability, weather conditions, and route scheduling. While we strive to accommodate requested delivery dates, we cannot guarantee specific delivery times. Emergency deliveries are available for an additional fee.
2.2 Safety Requirements
Customers must ensure safe access to propane tanks and storage areas. We reserve the right to refuse delivery if safety conditions are not met, including but not limited to blocked access, unsafe tank conditions, or hazardous environmental conditions.
2.3 Pricing and Measurement
Propane prices are subject to market fluctuations and may change without notice. All deliveries are measured by our calibrated equipment, which measurements shall be final and binding.
3. Hardware and Product Sales
All hardware and products are sold as-is unless otherwise specified. Prices are subject to change without notice. Special orders require full payment in advance and are non-refundable. Returns of stock items must be made within 30 days of purchase with original receipt, subject to a 15% restocking fee.
4. Online Transactions and Website Use
Our website is provided for your convenience in accessing account information and placing orders. You agree not to use our website for any unlawful purposes or in any way that could damage, disable, or impair our systems. All online orders are subject to acceptance and verification.
5. Privacy and Data Collection
We collect and use personal information necessary to provide our services, including contact information, payment data, and service history. This information may be shared with service providers necessary to fulfill our obligations to you. We do not sell personal information to third parties for marketing purposes.
6. Limitation of Liability
THE COMPANY'S LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER FOR THE SPECIFIC SERVICE OR PRODUCT GIVING RISE TO THE CLAIM. THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
7. Product Warranties and Disclaimers
Products are warranted only by their original manufacturers. The Company makes no warranties regarding products beyond those provided by manufacturers. EXCEPT AS EXPRESSLY STATED, ALL SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
8. Customer Responsibilities
Customers are responsible for:
- Maintaining safe and accessible service locations
- Providing accurate billing and contact information
- Timely payment of all charges
- Proper handling and storage of propane and equipment
- All service fees, labor costs, and transportation charges associated with the removal, retrieval, or return of any and all equipment owned by Edinger Propane Gas Incorporated, including but not limited to propane tanks, regulators, gauges, and related hardware
- Compliance with all applicable laws and regulations
9. Termination of Service
Either party may terminate service with written notice. The Company may immediately terminate service for non-payment, safety violations, or breach of these Terms. All outstanding balances become immediately due upon termination.
10. Changes to Terms
The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website or notification to customers. Continued use of our services constitutes acceptance of modified Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the state in which the Company is incorporated. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits against the Company.
12. Payment Terms and Automatic Payment Authorization
IMPORTANT NOTICE: By providing your credit card information to Edinger Propane Gas Incorporated, you hereby authorize us to automatically charge your credit card on file for any outstanding balances, fees, or charges without providing additional notice to you.
12.1 Automatic Payment Authorization
You expressly authorize the Company to charge your credit card, debit card, or other payment method on file for:
- All product purchases and service fees
- Outstanding balances on your account
- Late payment fees and penalties
- Emergency delivery charges
- Any other charges related to your account
12.2 Payment Processing
Payments will be processed automatically when charges are incurred or when accounts become past due. You agree that no additional authorization or notice is required for these automatic charges. Payment is due immediately upon delivery or service completion.
12.3 Failed Payments
If payment cannot be processed, you will be charged a fee of $35.00. You remain responsible for all outstanding balances plus applicable fees. Service may be suspended until payment is received.
13. Credit Card Storage and Security
The Company maintains credit card information in compliance with Payment Card Industry Data Security Standards (PCI DSS). Your payment information is encrypted and stored securely. By providing payment information, you consent to its storage and use for automatic billing purposes.
You are responsible for notifying us immediately of any changes to your payment information, including card expiration, cancellation, or changes to billing address. Failure to maintain current payment information may result in service interruption.
